	    <title>April Legal &amp; Compliance Update: USDOL requests $14 million to combat the misclassification of workers as Independent Contractors</title>

	The 2014 federal budget underlines the government&amp;rsquo;s determination to crack down on Independent Contractor misclassification and increase tax revenues by increasing resources that will enable greater enforcement through increased federal and state investigations and audits.&lt;br /&gt;
	&lt;br /&gt;
	According to the USDOL, employee misclassification &amp;ldquo;deprives workers of benefits and protections to which they are legally entitled and puts law-abiding businesses at a disadvantage against employers who violate the law&amp;rdquo;.&lt;br /&gt;
	&lt;br /&gt;
	The request for multi-million dollar funding is based on the agencies estimates that up to 30 percent of companies have misclassified Independent Contractors. Memoranda of Understanding (MOUs) have been signed with California, Colorado, Connecticut, Hawaii, Illinois, Iowa, Louisiana, Maryland, Massachusetts, Minnesota, Missouri, Montana, Utah, and Washington, as well as with the Internal Revenue Service (IRS). The USDOL has also announced that &amp;ldquo;MOUs with additional states are being explored, which will increase the coordination and sharing of information between WHD and other stakeholders.&amp;rdquo;&lt;br /&gt;
	&lt;br /&gt;
	The agency will &amp;quot;use its resources as part of an initiative to detect and deter the inappropriate misclassification of employees as independent contractors and strengthen and coordinate Federal and State efforts to enforce labor violations arising from misclassification. Individuals wrongly classified as independent contractors are denied access to critical benefits and protections &amp;mdash; such as family and medical leave, overtime, civil rights laws, and unemployment insurance &amp;mdash; to which they may be entitled as regular employees. Worker misclassification also generates substantial losses to the Treasury and the Social Security, Medicare and Unemployment Insurance Trust Funds.&amp;quot;&lt;br /&gt;
