A new California law that came into effect on January 1st introduces huge penalties, in addition to liability under existing law, for cases of Independent Contactor misclassification. Driven by a need for increased revenues and a perceived tax gap of billions of dollars, federal and state agencies are pursuing companies who may be misclassifying Independent Contractors more aggressively than ever.
This new law subjects companies and individuals to penalties of up to $25,000 per violation for misclassification, creates employer liability for fees and deductions imposed on misclassified contractors, and makes consultants and others who advise businesses on independent contractor issues subject to liability.
